How to File for an Appeal
A defendant or a prosecutor may file for an appeal within 30 days of a conviction, acquittal, or sentence. Fines must be paid in order to file an appeal, otherwise the Application to File an Appeal Without Paying Fine is required to be submitted in addition to the appeal forms. Fine payments are only accepted at a Provincial Offences Court Office. All appeal applications can be found here.
Appeal forms are available at the Court Services department, but must be filed at:
Ontario Court of Justice
700 N. Christina Street
Sarnia, ON N7V 3C2
Telephone: 519-333-2950
Once an appeal package has been filed, the Ontario Court of Justice will set an appeal hearing date which will be sent to the required parties.
For more information, the Ontario Court of Justice has prepared a Guide to Appeals for Provincial Offences matters.
